By signing this document, both parties agree as follows:
- The Customer hereby assigns and transfers full ownership of their Claim to AirReclaim.
This Assignment includes the Customer's transferable rights to claim monetary compensation, damages or reimbursement under Regulation (EC) No 261/2004, the UK Air Passenger Rights Regulations ("UK261"), the Montreal Convention of 1999 ("MC99"), any other applicable air-passenger-rights law accepted by AirReclaim, or as a gesture of goodwill, arising from the disrupted flight or baggage incident identified by the booking reference above or in the associated claim record (the "Claim").
The Claim does not include any claim for passenger death, bodily injury or personal injury unless AirReclaim expressly accepts that claim in writing.
- AirReclaim accepts this transfer by issuing this Assignment Agreement to the Customer for signature and hereby acquires the Customer's rights to the Claim, together with the corresponding transferable rights and obligations.
From the time the Customer signs this Agreement, AirReclaim becomes the sole legal owner and claimant of the Claim and acts in its own name, not as the Customer's agent or representative, except where a separate authority or power of attorney is required for a particular procedural act.
- This Assignment Agreement is made in accordance with the AirReclaim Terms of Service, Privacy Policy, Withdrawal and Reassignment Policy and applicable fee information, which the Customer confirms they have read and accepted before signing this Agreement.
- This Assignment Agreement entitles AirReclaim to the same transferable rights and powers that the Customer previously held within the scope of the Claim. In particular, AirReclaim is entitled to:
a. act before the Airline and any other relevant third party in amicable, administrative, ADR, judicial or enforcement proceedings;
b. initiate, submit, conduct, combine, negotiate, settle, discontinue, terminate and enforce any legal or extrajudicial proceeding relating to the Claim, individually or together with claims belonging to other passengers where permitted;
c. obtain information, documents and evidence required from the Airline, airports, booking agents, handling agents, administrative bodies, aviation authorities and other relevant third parties, where permitted by applicable law;
d. collect, recover and receive all payments relating to the Claim into a bank account designated by AirReclaim, including compensation, damages, reimbursement, transferable interest and recoverable legal or procedural costs; and
e. appoint and authorise any lawyer, law firm, solicitor, counsel, expert, translator, collection provider or other representative to assist or represent AirReclaim in connection with the Claim.
- This Assignment Agreement takes effect on the date and time the Customer signs it.
It may be used as written notice of the Assignment to any third party, including the operating Airline.
Where notice is legally required, the Assignment will take effect against the relevant third party from the date that party receives this Agreement or another written notice sufficiently identifying the Assignment.
This Assignment Agreement may be accompanied by AirReclaim's payment request, the associated claim record and the electronic-signature completion certificate.
- The Customer confirms that:
a. they are legally entitled to the Claim;
b. the Claim has not previously been assigned, sold, finally settled or paid, except as disclosed to AirReclaim;
c. no other claims company, lawyer or representative is pursuing the same Claim, except as disclosed to AirReclaim;
d. they will not assign the Claim again, pursue or assert it in their own name, appoint another representative, independently negotiate or settle it, or otherwise dispose of it while AirReclaim owns it;
e. they will promptly forward to AirReclaim any communication, request, offer, settlement or payment received from the Airline or another relevant party; and
f. they will provide reasonable information, documents and cooperation necessary to pursue the Claim.
If the Customer receives payment relating to the Claim directly, the payment will be handled in accordance with the AirReclaim Terms and applicable fee information.
- The Customer requests and authorises the Airline and any other relevant third party to disclose to AirReclaim the personal data, booking information, flight records, baggage records, documents and other information reasonably required to verify, pursue, settle or resolve the Claim, subject to applicable data-protection law.
- In accordance with the AirReclaim Terms, Polish law applies to this Assignment Agreement and to any dispute concerning its interpretation or validity.
This choice of law does not remove any mandatory consumer protection that applies under the law of the Customer's habitual residence.
The law governing the underlying Claim may separately determine its assignability, the effect of the Assignment against the Airline, any required notice and whether payment discharges the Airline.
- If this Assignment Agreement is produced in more than one language, each language version is equally authoritative, subject to mandatory law.
Single required confirmation
The Assignment is executed by the Customer's electronic signature. No separate assignment checkbox is required.
The signing flow uses one required, unticked checkbox:
I confirm that I have read the Privacy Policy and accept the Terms of Service, Withdrawal and Reassignment Policy and applicable fee information. I expressly request AirReclaim to begin work immediately before the withdrawal period ends and acknowledge that, where the service is fully performed, I may lose my right to withdraw to the extent permitted by law.
The exact accepted document versions must be shown directly below the checkbox and stored in the completion certificate and audit record.
Execution
- The signing date is inserted automatically by the signing provider when the Customer signs.
- The exact UTC completion time is retained in the electronic-signature completion certificate and verified webhook evidence.
- The Customer's electronic signature is kept inside the dedicated signature area.
- The complete legal name, AirReclaim claim ID, and completion certificate reference are prefilled from the immutable claim and signing records.
